Boa-pinta, culto, ótimo orador e sempre vestido com ternos de grife, o delegado André Luiz Martins Di Rissio Barbosa conquistou, em dezesseis anos de carreira, a admiração de grande parte de seus colegas. Um dos coordenadores do Departamento de Administração e Planejamento da Polícia Civil – responsável por aprovar o orçamento da corporação, inclusive verbas extras para compras de armas e equipamentos –, foi eleito em janeiro, aos 42 anos, presidente da Associação dos Delegados de Polícia do Estado de São Paulo. É o mais jovem presidente da história da entidade. No dia 29 de junho, essa boa imagem começou a ruir. Acusado de integrar uma quadrilha que liberava mercadorias importadas ilegalmente no Aeroporto de Viracopos, em Campinas, Di Rissio foi preso pela Polícia Federal. Na semana passada, surgiram novas denúncias contra ele. Escutas telefônicas autorizadas pela Justiça apontaram uma suposta influência em ações do Departamento de Investigações sobre o Crime Organizado (Deic) e de delegacias de Santos, impedindo a apreensão de mercadorias e a prisão de suspeitos.
O Ministério Público Federal investiga depósitos feitos em uma conta não declarada em Miami, nos Estados Unidos. Pesam contra Di Rissio acusações de formação de quadrilha, sonegação fiscal, falsidade ideológica e posse ilegal de armas de fogo, entre outros crimes. Além da Polícia Federal e do Ministério Público Federal, o delegado está sendo investigado pelo Ministério Público Estadual.
Figurinha fácil de ser encontrada em restaurantes estrelados dos Jardins, Di Rissio tinha um estilo de vida mais compatível com o de um playboy do que com o de um delegado de polícia que ganha menos de 7 000 reais por mês. Até ser preso, morava com a mulher, Mylene Mendes Abrahão, também delegada, e uma filha de 4 meses em um apartamento de alto padrão no Morumbi, avaliado em 1 milhão de reais. Segundo as gravações grampeadas, ele estava negociando a compra de um outro, por 1,5 milhão de reais. Quando foi detido, policiais apreenderam na garagem de seu prédio dois Jaguar blindados – que custariam, juntos, de acordo com o Ministério Público Federal, 300 000 reais –, quatro relógios importados de grife (30 000 reais cada um), dois sacos de supermercado abarrotados de jóias, 30 000 reais em dinheiro e duas autorizações de transferência para uma conta em Miami – cada uma no valor de 20 000 dólares. “Estou estarrecido”, afirma o delegado e deputado estadual Romeu Tuma Júnior. “Era uma liderança nova, que havia conquistado o respeito da classe.”
A principal plataforma de Di Rissio para vencer a eleição à presidência da associação dos delegados era o combate aos baixos rendimentos da categoria – São Paulo paga o segundo menor salário do país para um delegado em início de carreira (3.000 reais), à frente apenas do estado da Paraíba. Ataques aos secretários de Segurança Pública e da Administração Penitenciária eram comuns. “Temos um amador na Segurança e outro incompetente na Administração Penitenciária”, chegou a dizer, após as ações do PCC em maio. Na festa que marcou sua posse, no hotel Maksoud Plaza, estiveram presentes diversas personalidades, como o senador Eduardo Suplicy e os deputados federais Luiz Eduardo Greenhalgh e José Eduardo Martins Cardozo, todos do PT. As fotos do evento foram publicadas na revista Caras.
Outro alvo de sua língua ferina era o Ministério Público. “Os promotores não podem investigar crimes porque a Constituição não permite”, disse Di Rissio. “Quando fazem isso, denigrem a imagem da polícia.” Ironicamente, é o Ministério Público que a cada semana descobre novas falcatruas do delegado. “Pela proximidade que os policiais civis têm dos criminosos, é muito fácil eles se deixarem corromper”, afirma o coronel José Vicente da Silva, consultor na área de segurança e ex-secretário Nacional de Segurança Pública. “O que mais surpreende é que as denúncias recaiam sobre uma pessoa que se vangloriava de sua postura ética.”
O Grupo de Atuação Especial e Repressão ao Crime Organizado do Ministério Público Estadual (Gaeco) ouviu vinte CDs com conversas grampeadas nos telefones de Di Rissio, que resultaram em 190 páginas de transcrições. O que mais chamou a atenção dos procuradores é que em nenhuma ligação ele fala sobre operações policiais ou assuntos de interesse da associação de delegados. Em um ano inteiro de escutas – de julho do ano passado a junho deste ano –, só tratou, de acordo com o Gaeco, de ações à margem da lei. Na operação da Polícia Federal batizada de 14 Bis descobriu-se que Di Rissio servia de ponte entre empresários, despachantes e o delegado Wilson Roberto Odornes, então titular da delegacia da Polícia Civil dentro de Viracopos. Era Di Rissio quem oferecia propina para que fiscais da Receita Federal e funcionários do aeroporto fizessem vista grossa para cargas irregulares e notas subfaturadas (entre 10% e 20% dos valores reais). Os auditores da Receita Federal cobravam de 10 a 14 dólares por quilo de mercadoria liberada ilegalmente. A Polícia Federal, no entanto, ainda não conseguiu estimar em quanto essa quadrilha lesou os cofres públicos. Dezesseis pessoas foram presas, entre elas Di Rissio e Odornes. Para intermediar as negociações em Viracopos, Di Rissio ganharia cerca de 50.000 reais fixos por mês e participaria dos lucros das operações.
As escutas flagraram ligações de Di Rissio pedindo favores a delegados do Deic e a policiais em Santos. Essas conversas mostram que o delegado playboy também negociava relógios. “Tá chegando o Dia das Mães. O que você tem pra mim desta vez?”, diz a um intermediador. “Um Rolex, 14 000”, ouve como resposta. Os preços eram sempre passados em dólares. Di Rissio chegou a mostrar interesse em pelo menos quinze modelos de relógio, principalmente das marcas Rolex e Cartier. Outra negociação flagrada pelos grampos foi de uma cobertura dúplex de 660 metros quadrados na Rua José Maria Whitaker, no Morumbi. “Achei um de 1,5 milhão…”, conta a corretora. “Pô, meu apartamento tem 500 metros quadrados, não vou sair daqui para um lugar pior”, diz o delegado. A corretora esclarece: “Não, esse é dúplex. Tem 660 metros quadrados”.
Em uma das ligações, gravada em julho do ano passado, ele garante estar ajudando na negociação entre Robinho, então jogador do Santos, e o Barcelona, da Espanha. Dando a entender que era conselheiro do Santos (o que ele não é), o delegado combinou uma comissão caso a venda fosse fechada. O negócio não se concretizou – Robinho foi para o Real Madrid –, e ele ficou sem a bolada. Torcedor santista fanático, o delegado costumava ir aos estádios assistir aos jogos do time da Vila Belmiro. Filho do desembargador Eduardo Antonio Di Rissio Barbosa, do Tribunal de Justiça, Di Rissio era aparentemente o policial exemplar. Teve forte atuação no ABC paulista. Foi delegado em Santo André e São Caetano, professor de direito em uma universidade da região e secretário de Assuntos Jurídicos de Diadema. Em 2003, completou o mestrado em direito constitucional na PUC, onde depois entrou no programa de doutorado.
Di Rissio está detido provisoriamente na Penitenciária da Polícia Civil General Ataliba Leonel, na Zona Norte. Ele aguarda o julgamento de um habeas corpus. Segundo seu advogado, Antônio Claudio Mariz de Oliveira, o delegado nega todas as acusações. Mariz de Oliveira reconhece que muitas vezes amigos e conhecidos solicitavam os préstimos de Di Rissio. “Mas sempre dentro da absoluta legalidade”, afirma. “Di Rissio teria outras rendas, como dono de uma empresa de consultoria na área de segurança e contra-espionagem industrial.” Sua mulher, Mylene, receberia ainda uma mesada do pai, fazendeiro. Um dos advogados criminalistas mais conhecidos do país, com um currículo que inclui a defesa da empresária Eliana Tranchesi, do ex-prefeito Celso Pitta e de Suzane von Richthofen, a estudante que mandou matar os pais, Mariz de Oliveira costuma cobrar entre 50.000 e 100.000 reais por um habeas corpus. No caso de Di Rissio, entretanto, afirma que abriu uma exceção. Aceitou atender o delegado de graça. Não precisava. A julgar pela vida que leva, seu novo cliente não teria dificuldade para lhe pagar os honorários.
